Assets Are Protected Automatically During Divorce
When a divorce is filed, New York property division law now requires that all assets be frozen, other than those required to cover costs of living. This is important, because it prevents a spouse from attempting to burn through or transfer assets while the case is pending. Of course, your spouse may still try, but it is now a simple matter for me as your attorney to stop this from happening.
Sort Out Marital Property and Non-Marital Property
Sorting through what property is marital and what is non-marital can be complicated. As a general rule, if you had it prior to the marriage, it is non-marital. Otherwise, it is a marital asset. This can get complex quickly however. Certain assets may have characteristics of both marital and non-marital property, such as a house that was purchased prior to the marriage, but on which both spouses made payments during the marriage.
